GenHERate IQ is an educational initiative of the Carlos Simon Foundation for Research in Women’s Health and does not constitute a separate legal entity.

2. Purpose

This Legal Notice governs access to, navigation and use of genherateiq.com, as well as the responsibilities arising from the use of its content, services and functionalities.

Access to and use of the website confers the status of user and implies acceptance of the provisions contained in this Legal Notice.

Where specific services or functionalities are subject to particular terms and conditions, these will be communicated to the user prior to their use or purchase.

3. Conditions of Use

Users undertake to use the website diligently, lawfully and in accordance with applicable legislation, good faith, public order and this Legal Notice.

It is prohibited to use the website for unlawful purposes or purposes contrary to applicable legislation; to infringe the legitimate rights or interests of third parties; to introduce, transmit or disseminate unlawful, fraudulent, harmful or technically damaging content; to attempt to gain unauthorised access to systems, accounts, networks or information; or to interfere with the normal operation of the website or the services provided through it.

GenHERate IQ provides educational content and programmes relating, among other areas, to reproductive medicine and women’s health.

The content available on the website is provided for educational and informational purposes and does not, in itself, constitute individual medical advice, diagnosis or medical treatment.

Access to certain programmes, courses or content may be subject to registration, purchase, payment or acceptance of specific terms and conditions.

The purchase of courses and educational content shall, where applicable, be governed by the Terms and Conditions for Online Course Purchases available on the website.

In accordance with Organic Law 1/1982 of 5 May on civil protection of the right to honour, personal and family privacy and one’s own image, and Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights, the Carlos Simon Foundation for Research in Women’s Health has the express consent of its staff for photographs of their image to be taken and published on its website or other digital media, solely for the purpose of identifying professionals who form part of the Carlos Simon Foundation for Research in Women’s Health, as documented through the corresponding authorisation form.

The Carlos Simon Foundation for Research in Women’s Health shall not be responsible for the truthfulness, accuracy, adequacy, suitability or updating of information supplied by third parties through such platforms.

Content published on social media is for informational purposes. The Foundation shall not be responsible for decisions made by users on the basis of such information or for damages suffered by users or third parties as a result thereof.

The Foundation will endeavour to maintain the quality of the information published through the channels it manages and, where permitted by the relevant platform, may remove or moderate offensive, inappropriate, unlawful or unrelated comments, photographs, videos or other content.

Access to the social networks and online communities used by GenHERate IQ depends on services provided by third-party information society service providers. The Foundation cannot guarantee their reliability, quality, continuity or operation and cannot prevent their suspension, cancellation or unavailability for reasons beyond its control.

The Foundation shall not be liable for damages suffered by users as a result of failures or disconnections affecting third-party social networks that may result in loss of information, suspension, cancellation or interruption of services.

Social networks and online communities may provide access to links and other websites. In accordance with Law 34/2002 of 11 July on Information Society Services and Electronic Commerce, the Foundation shall only be liable for content and services supplied through linked sites where it has actual knowledge that such content or services are unlawful and has failed to act diligently to remove or disable the corresponding link.

If a user considers that a linked website contains unlawful or inappropriate content, they may notify the Foundation using the contact details provided in this Legal Notice.

12. Data Protection Officer

The Carlos Simon Foundation for Research in Women’s Health has voluntarily appointed a Data Protection Officer, through whom users may submit complaints, claims or suggestions concerning the processing of their personal data.
